WHY FILE TAXES IN THE UNITED STATES?

All individuals living in the United States, except those with certain specific types of non-immigrant visas, are required to file a tax return. USCIS understands that paying taxes is an important factor contributing to a good moral character. Therefore, even if you are here without status, and considering that this situation may change in some way at some point, you should still pay taxes.

CLARIFICATIONS

If you are not a United States citizen but live and earn money in the United States, you may need to file a tax return. You are a United States resident for tax purposes if you have a green card or meet the substantial presence test for the calendar year (from January 1 to December 31). If you are a permanent resident, you must file a tax return every year. This return covers income received from January to December of the previous year. The deadline for filing the return is April 15.

In most cases, the days the foreigner is in the United States as a teacher, student, or intern on an “F,” “J,” “M,” or “Q” visa do not count. This exception is for a limited period of time. As a permanent resident, you must file tax returns with the Internal Revenue Service (IRS) and your state, local, or city tax department, if necessary. If you do not file a tax return during the period you live outside the United States, for any period of time, or if you declare yourself as a “non-resident” on your tax return, the United States Government may determine that you have relinquished your permanent resident status.

HOW TO PAY TAXES

Income Tax: Income tax is paid to the federal government, most state governments, and some local governments. “Taxable income” is the money you receive from wages, self-employment, tips, and the sale of properties. Most people pay income tax with money withheld from their paychecks. The amount of income tax you owe will depend on how much you earn. Income tax rates are lower for people who earn less money. Anyone who has income, resides in the United States, and meets certain requirements must file a tax return and pay the income tax owed.
